Congresswoman Ann Wagner (R-MO), Chair of the Financial Services Subcommittee on Capital Markets, has expressed approval of the recent United States Supreme Court decision in SEC v. Jarkesy. In her statement, Wagner emphasized that the ruling safeguards due process rights for all market participants, enhances accountability and transparency, and strengthens public trust in institutions.
"The Supreme Court’s decision today in SEC v. Jarkesy protects the due process rights of all market participants, increases accountability and transparency, and enhances public trust in our institutions," said Wagner. She highlighted a recent subcommittee hearing which examined whether the use of Administrative Law Judges by the SEC violates the 7th Amendment. According to Wagner, it was evident during this hearing that "the SEC was acting as judge, jury, and executioner" and infringing upon the individual rights of Main Street investors.
Wagner asserted that people deserve a trial by a jury of their peers rather than decisions made by bureaucrats. "This decision is a victory for all Americans who need to be protected from out-of-control regulators dead-set on ignoring our Constitutional rights," she concluded.
